Statement with regard to the NIH request to comment on the design of their Policy with regard to open-access

Statement of the Workgroup Open Access Publishing of Euroscience

I. General
The term ‘policy’ is reserved for a longterm policy, to be valid for many years to come, in contrast to a business model, which has to comply with the existing policy, and is reflecting the actual strategy to earn money.

We praise NIH National Institute of Health for the strategy to ask external experts before fixing its long term policy with regard to scientific document access.

We discuss here the Policy of NIH, necessary with regard to handling scientific documents of external authors in the general field of health sciences. NIH intends to store and post scientific documents on the Web.

To design a policy means to envisage the far away future scenario with regard to Scientific Information Management. This needs a minor percentage of finances of the total costs of science and academic education. Thus, historically, scientists have at each time exploited fully all technical possible services, which could make research and education more effective, or asked the market for it.

So, as a first recommendation we propose that NIH asks specifically the large Science Organisation, Scientists and authors, what service types they see to need to make the research work as effective and competitive as possible. That means, to ask the users what they need and ask for, then ask the information management industry and academic library services what of this they can serve, then endelve together to find funding and ways to finance it.

Instead at present the NIH is apparently under direct pressure by large international commercial service providers to bend the NIH service profiles such as to optimally support the present business model of the publishers (subscription model, toll access), which reflects the paper-age business model.

II. What does Science request from a professional information management service bundle?

Asking scientists and observing how they work, reveals obvious needs and requirements for effective scientific work. These have not changed over the last 500 years and will not change by the present technical revolution from the paper-age to the digital age. Basically scientists need for effective and competitive work:
- to find, access, read, extract, import, re-use relevant work on the same topic by other authors, may they be distributed around the globe.
- make their own work worldwide easily accessible, readable, extractable, importable, re-usable, by anyone with no barrier.
- Both, authors and users, as scientists, need services for intelligent searching, filtering by relevance, assuring integrity, long-term-availability, long-term readability, and of scientific and technical quality of their work, written or looked for. They expect that professional services exploit the most modern techniques for their realization.

The digital age allows the design and realization of such services which fullfill the requests: metadata and field-specific markup-languages allow intelligent semantic filtering, search engines covering all of the worldwideweb can be adapted to find and filter relevant documents, digital download and import into local research work is easy once the author used non-proprietary encoding (such as html, .latex, etc.), integrity of the document can be realized by the author’s local University Library services, long-term availability by its sending routinely a digital copy to the respective National Library.

The quality of the content can be served by refereeing,- but in exploting the possibilities of the digital age, much richer and and more misuse-resistant services can be added such as open online forum before refereeing, conecutive refereeing levels (such as at CERN) of increasing scrutiny, adding online comments by experts, etc.

Many of the service types, named here, are invarious stages of exploration at several places. Most of these services have as a preconditions,
1. that the documents are digitally written in a non-proprietary language, readable on any operating system, by any text-editor,
2. that the access to the document is open-access, that is, there exists a copy on the web, provided by any host, that is online digitally available by anyone with no barrier, technically or financially,
3. that there are trusted and professional competent service providers for the named services,
4. that professional and trusted refereeing is provided by the respective professional community or small groups of colleagues trusted by them.

III. What the NIH should adopt as Policy on Scientitic Information Management
To comply the requests for services as noted above, the NIH, as the leading government paid professional Institution in the US in the field of health sciences, it should assure by its policy and in thriving for it
1. It will ask and thrive to serve the needs of the scientists and only these, by establishing a trusted and established way to communicate with the scientific community in the field of health sciences, and take the findings as prime goal.

2. It will communicate with the scientific communities in the field of health sciences as to which documents to provide a central digital copy. (e.g. depending on scrutiny level of refereeing).
3. It will put these document copies for free and open access on its Web server.
4. It will develop digital services, asked for by the scientists to work with digital copies such as e.g. named above and provides them.
5. It will thrive to become and stay as a trusted long term stable provider of digital add-on services, on long-term available readability and integrity of copies.
6. It will cooperate closely on all levels with other such Institutions in the world such as the University of Southampton (UK), Univ. of Minho (PT), CNRS (FR), and the DINI (GE). DINI has set up already a policy similar to the one proposed here and is handing out certificates for University Libraries abroad [list] and even overseas, if their digital services have been scrutinely refereed whether
they conform with the above listed requests.

Concluding, I propose that the NIH develops to a trusted professional digital document center serving powerful and stable add-on digital services, and draws digital copies of health sciences scientific documents from as many Institutes abroad as possible and serves their open access availability, readability and integrity.

Clearly, there is no room for compromises on documents to hide for a given time period, for serving only analogue (scanned) copies (as requested in Germany by the publishing industry and its latest success in compromising the national copyright law).

Instead a fruitful positive cooperation of the NIH with the future professional digital scientific information management service providers and industry is proposed to request the development of services as asked by the community and elucidated by the NIH.

IV. How to finance the Scientific Information Management?
Financing a service is a totally separate topic from the question of open-access.
Generally, the better the new professional services of the NIH will fit the demands by the scientific community, the more professionally served will the research process be and thus the easier it will be to raise funds to pay the services, because then the community bodies, the NIH as professional service Institution and the commercial service providers will act coherently to convince government funding for the system.

Novel models for open access funding are numerous by now, and become more and more successful in funding the services. By the NIH policy proposed here, the NIH would become a leading institution in the negotiations for a suitable funding way and business model. As an example we mention SCOAP3, the coordinated scientfic-community and publisher business model in the field of high energy physics to assure open access.

A Petition to the German Parliament (Deutscher Bundestag) for Open Access of documents in science and research has been launched by Lars Fischer, see the English version of the Petition.
It can be signed online at Signing the petition.
Signing by colleagues from foreign countries is encouraged and extremely welcome.

The Coalition for Action “Copyright for Education and Research” suggests that all the signatees of the Göttingen Declaration), the Berlin Declaration, the Budapest Open Access Initiative and the EC Open Access Petition — as well as all other scholars in science and education — sign the petition, see the Press Release (with its english tranlation).

1. register: call the link https://epetitionen.bundestag.de and go for the second line ‘registrieren’ and register. [and enter your Country at the line ‘Land’) as well as create your own password.
2. you get an email with your permanent Username (Benutzername) which should be the word ‘Nutzer’ together with a 6-decimal number.

WHAT IS OPEN ACCESS? Free online access to all peer-reviewed research articles (2.5 million annual articles published in 25,000 peer-reviewed journals, in all fields of science, social science and humanities, worldwide) for all potential users — researchers as well as general public.

WHY OPEN ACCESS? To maximize research uptake, usage, applications, impact, productivity and process — in the interests of the tax-paying public that has funded it and for whose benefit the research is conducted — by making it freely accessible online to all its intended users worldwide, and not just to those whose institutional libraries can afford a subscription to the journal in which it happened to be published.

HOW OPEN ACCESS? Summary:
The Coalition for Action “Copyright for Education and Research” recommends all researchers not to agree to or even to veto against the most recent change of the VG Wort contract (the German collecting society for authors). The Coalition for Action has informed their institutional and individual subscribers of the Göttingen Declaration about this recommendation. The Coalition for Action considers the interests of education and research to achieve free access to information and knowledge to be at risk when, as the VG Wort contract suggests, all texts of German authors will be withdrawn from Google Book Search and when access (eventually and probably under commercial conditions) can only be renewed under a licence controlled by VG Wort. The Coalition for Action calls upon VG Wort to take the interest of science and education in free access into account in any case. Otherwise there might be a need to establish alternative means to respond to the growing interest of researchers to exercise their rights against Google themselves.

The research community’s need for Open Access to research

Researchers are paid directly or indirectly through governmental funding. They work in publicly-funded institutions and universities. They exchange their findings through refereed journal articles: this exchange is an absolute necessity for the progress of their research.

These researchers are ‘give-away authors’ (in contrast to ‘trade authors’, who write for royalties or fees). Researchers want their findings to be immediately accessible to be read, used, applied and built-upon by any user worldwide, with no financial or other barriers to access.

There is a global development in progress for providing “Open Access” (OA) to scientific and scholarly research (see the introductory text on OA below), with a rapidly growing recognition and support worldwide from researchers, their institutions and their funders, as well as from the tax-paying public that supports the research.

But there are still many misunderstandings of Open Access, even among its proponents. And there is also opposition to Open Access — mostly from large, commercial publishers. Open Access can be provided by posting digital copies of the author’s final draft of all refereed journal articles on the author’s institutional website immediately upon acceptance for publication by the journal.

We have prepared some very focused questions for the EU-parliament candidates; the candidates’ replies will then be distributed in the research community. Originally sent to the Euroscience WG on Open Access under the title “A specific law for scientific information?”

Within the Euroscience Open Access Group, five questions have been asked on the evolution of the legal framework for access and usage of scientific publications. Here are my personal answers.

1. Are there special rights for authors in science and education in your copyright regulation?

There are no rights for the authors, but rights to exploit commercially for the publishers, called ‘copyright for authors’. In Germany the ‘Urheberrechtsgesetz’ has already been amended twice (Korb 1 and Korb 2 zur Anpassung des Gesetzes). The few ‘exceptions’ which e.g. allow users at Universities to use small parts of published material in a closed circle group of persons (e.g. a seminar) have not been withdrawn for now. The German Coalition Coalition for Action “Copyright for Education and Research” is calling for a third amendment to address specifically the needs of science and scientists. The coalition comprises all major Science Organisations in Germany, 359 scientific institutions, learned societies and federations, as well as 6.990 individual personalities of Science.
